I've just taken over as a salon manager and have put in place some contracts standard ones for most hairdressers, everyone was happy about having the working hours etc on paper with the uk as it stands. one of the staff is not happy about the part about not working within so many miles of the salon within 6 months of leaving and about taking clients with her from records, she has asked what would happen if shes not willing to sign, I know if she was to take wages and stay on in the salon without sign its classed as signing, but what could and should i do if she says shes not signing!! do i ask her to leave giving her a weeks wages ? i'm unsure PLEASE HELP !!!!
hey there- this is a tricky one because there is an answer which is legally right but that might not help your situation. One line I always use with Clients is that, "its no point being right, if you're dead" which is a strange (I admit) way of saying that sometimes you have to be commercial first and technically correct second.
There are a few questions to raise such as which templates you use (i.e. are they NHF?) and what is the radius referred to. Your contracts shouldnt be too prohibitive (depending on seniority) but there is absolutely no problem with preventing soliciting of customers.
If she proves adamant you could give with one hand and take with the other- in other words allow her radius/time to be reduced to work elsewhere (6 months is a little harsh in these times with mortgages to pay) but state there is an 1 year prohibition on clients.
The key is that you know her better than we do so try to assess why she is querying this and then tailor your move accordingly. Happy to chat it through. Good luck!
She left a salon which was 2mins away, within feet so to say, and walked into our salon for a job, i wasnt the manager at the time, she says she wants to know she can work local still if she leaves, shes is the type who doesnt really like rules and is anti anything which she doesnt like. dont really like beening asked to do anything to help
I suppose the question is, what do you want to do with her (if you had free reign)?
Hi this is a difficult one , but i suppose you must look how much she worth to the salon . In my experience ( Ive had a salon 10 years) it sounds as though she walked into your salon in with past problems and may always be a difficult one. I would keep as you are but have a back up plan . Are you computerised because if you are your software will give you back up.. if she ever leaves. Also have a level 3 stylist who can help blow dry regularly - it helps customer confidence in having different stylist occasionaly. I try to encourage stylists not to think that the customer belongs to them, afterall its you and the salon that 'introduces' the client to that stylist and the stylist is getting paid for their time. I think it comes down to fairness on both sides but be careful of having a trouble maker in your midst.
hi again, this one sounds like trouble and she will kick off, if not today then in the future, I would suggest that she considers rent a chair then as she thinks she's to good to be employed. Be really careful, people who are naturally confrontational usually know employment law backwards, are you members of nhf ? give them a ring they may be able to help.
